Tips on Getting a Model Release Signed

Getting a model release signed by your subject is often challenging, especially when you attempt to secure one on-the-spot. It may also be embarrassing for the photographer to ask the person just photographed to allow usage to their photos without any or little incentive. Although getting a model release in writing is common place when dealing with professional models, it may often be impossible or inappropriate to initiate with a non-professional subject. Below are some tips to improve your chances on getting that model release:

  1. Be Professional and Courteous - Dress and speak with poise. Make a good first impression and strike up a common conversation topic. Be sure you have business cards at hand to illustrate your legitimacy.

  2. Have a Good Reason – Provide a sincere speech to explain the purpose behind your project. You may wish to rehearse this first. A stuttering and poorly prepared introduction will harm your creditability.

  3. Explain Photography Usage – In simple terms, explain briefly how your subjects' photos may be used.

  4. Release May be Obtained Later – You don't have to get the signed release on the spot. If it proves to be difficult, tell them you just need their information first, so you could contact them later. Or give them your business card in case they change their minds. After all, you don’t need model release until you've found a buyer / publisher. Even an unreleased photo could worth something.

  5. Offer Free Prints – Offer it, then keep your promise and send a few good prints. Include the model release in the package and a return pre-paid envelope. You could also promise more prints once the release is signed and returned.

  6. Bargain and Entice Your Subjects – If you plan to send your work for potential commercial use, and you conclude your subject is reluctant to sign a free waiver, propose the revenue split opportunity or potential financial return.

  7. Finishing Touch: Track it in Metadata – Don’t forget to enter the details in the photo’s IPTC Metadata tags.

When all else fails, you could shoot first, ask for a release later. This is not a good social practice, but sometimes a photographer just got to do it. Although it's often consider rude to take picture first without the subject's permission, you do technically have the right to photograph anyone in a public setting in the United States, and retain the photos for non commercial keeping. But be prepared if you anger the subject; weigh your risk and reward benefits.

Another legitimate reason for this approach would be: if you attempt to capture a candid shot, notifying the subject with a model reason first may render the candid experience impossible.

In exchange for consideration of my engagement as a model by________________. hereafter referred to as the photographer, I hereby give the photographer, his/her legal representatives and assigns, and those acting with his/her permission, or his/her employees, the right and permission to copyright and/or use, reuse and/or publish, edit/alteration without restriction, or in which I may be distorted in character, or form, in conjunction with my own or a fictitious name, on reproductions thereof in color, or black and white made through any media by the photographer at his/her studio or elsewhere, for any purpose whatsoever, including the use of any printed matter in conjunction herewith.

I hereby waive any right to inspect or approve the finished photos that may be used in conjunction therewith or the eventual use that it might be applied.

I hereby release, discharge and agree so save harmless the photographer, his representatives, assigns, employees or any person or corporation, acting under his permission or authority, including any firm publishing and/or distributing the finished product, in whole or in part, from and against any liability as a result of any distortion, blurring, or alteration, optical illusion, or use in any composite form, either intentionally or otherwise, that may occur or be produced in the taking, processing or reproduction of the finished product, its publication, or distribution.

I hereby confirm that I am over twenty-one years of age, and I am competent to contract in my own name as stated above. I fully acknowledge I am entitled to no further compensation beyond what's listed below.
